AI-nergy ApS (“AI-nergy”, “we”, “us” or “our”) provides SolarPlanner, a business-to-business cloud service for technical solar and energy-project design.
This Privacy Policy explains how we process personal data when we operate our website and provide SolarPlanner. It does not make SolarPlanner a consumer service or a customer relationship management system.
1. GENERAL
1.1. Who we are
AI-nergy ApS, RĂĄdmandsgade 40C, 06.150, 2200 Copenhagen, Denmark, VAT ID DK43071432, is the controller for the personal data described in this Privacy Policy.
AI-nergy ApS also uses the registered secondary names AIenergy ApS, AI Energy ApS, AI-Energy ApS, AInergy ApS and EnergyAI ApS. Each name refers to the same legal entity.
In this Privacy Policy, “AI-nergy”, “we”, “us” and “our” mean AI-nergy ApS.
1.2. Scope and roles
SolarPlanner is available only to business customers and their authorised users.
We act as controller for business-account administration, business contacts, billing, website operation, security, legal compliance and our direct relationship with users and customers.
Customer Content is controlled by the relevant business customer. Where Customer Content contains personal data and we process it on the customer’s behalf, the customer is responsible for that content and the applicable Data Processing Agreement governs that processing.
2. PERSONAL DATA WE PROCESS
2.1. Business-account information
When an account is created, we process the authorised user’s name, business email address, organisation name and country of business.
2.2. Technical, security and website information
We may process technical information necessary to operate and secure our website and service, including device, browser, IP-address, log, error-reporting and security information.
2.3. Customer Content and Project Documents
SolarPlanner is designed for technical project information, including location, roof, design and energy-consumption data. We do not collect homeowner or end-customer information as part of the intended use of the service.
Customers may store documents, images and other Project Documents within a Project. These are customer-controlled documents. AI-nergy personnel do not access, view, review, use or disclose Customer Content or Project Documents except where the customer requests support, or where access is strictly necessary to investigate and resolve a security or technical incident.
Customers must not use SolarPlanner to store payment information, passwords, national identity numbers or other unnecessary personal information.
2.4. Bill-analysis feature
Where enabled, a customer may upload an energy bill for automated extraction of consumption information. We use the uploaded document only to extract relevant monthly, hourly or sub-hourly energy totals. We do not retain the uploaded bill image or other bill contents after extraction.
3. HOW WE USE INFORMATION
We use personal data only as necessary to:
- create and administer business accounts;
- provide, secure, maintain and support SolarPlanner;
- process billing and administer the commercial relationship;
- classify a project for billing purposes, such as residential, commercial or industrial project category;
- respond to customer support requests;
- detect, investigate and resolve security or technical incidents;
- comply with legal, accounting and tax obligations; and
- operate and improve the security and reliability of our website and service.
We do not sell Customer Content or personal data.
We may create and use aggregated and anonymised technical project data to improve SolarPlanner’s technical models and to develop or present aggregated technical results. Before using data for these purposes, we remove or exclude information that identifies, or could reasonably identify, a Customer, user or individual.
This use is limited to non-identifying technical information, such as project-size and project-type categories, technical system configurations, design outputs, energy metrics and non-identifying manual edits. It excludes names, email addresses, organisation details, free-text entries, Project Documents, and raw energy bills.
4. LEGAL BASES
Where GDPR applies, we process personal data on the following bases:
- performance of a contract or steps requested before entering into a contract;
- our legitimate interests in operating, securing and improving our business service;
- compliance with legal obligations, including accounting and tax obligations; and
- consent, where required, for non-essential cookies or similar technologies.
5. PROTECTION OF CERTAIN PERSONALLY-IDENTIFYING INFORMATION
We limit access to personal data and Customer Content to authorised personnel who need access for the purposes described in this Policy and who are subject to confidentiality obligations.
We use appropriate technical and organisational measures designed to protect information against unauthorised access, use, alteration, loss or destruction. No method of transmission or storage is completely secure; we continually assess and improve appropriate safeguards.
We may use carefully selected service providers to host, secure and operate SolarPlanner. Current providers and their functions are listed in our Subprocessor and Service Provider List.
We disclose information only where necessary to provide the service, comply with law, protect our rights or respond to a valid legal request.
6. WEBSITE VISITORS
Like most website operators, we collect limited technical information made available by browsers and servers, such as browser type, language preference, referring site, date and time of requests, and technical log information.
We use this information to operate, secure and understand the use of our website. We do not use it to identify website visitors unless necessary for security, fraud prevention or legal compliance.
7. DATA DELETION AND RETENTION
Upon a customer’s request to delete an account, we delete the account, Project data and Project Documents after a 15-day quarantine period. The quarantine period allows a customer to reverse an accidental deletion request.
We retain invoices and accounting records for the period required by applicable law. We may retain limited support, security and legal-compliance records where necessary for the relevant purpose or legal obligation.
8. COOKIES
A cookie is a small text file that a website stores on a visitor’s device and that the browser sends back when the visitor returns.
We use necessary cookies and similar technologies to operate and secure our website and service. We may also use Google Analytics to understand website use. Where required by law, we request consent before using non-essential analytics cookies.
You can control cookies through your browser settings and, where available, our cookie settings. Google also provides an opt-out browser add-on at https://tools.google.com/dlpage/gaoptout.
9. USE OF GOOGLE MAPS
Our website and service use Google Maps APIs to provide location, mapping and satellite-imagery functionality. By using this functionality, you agree to Google’s Terms of Service and acknowledge that Google’s Privacy Policy applies.
10. INTERNATIONAL TRANSFERS
We configure our principal cloud and service providers for processing in the EEA/EU where available. Some providers, including Google services, may process limited information outside the EEA depending on the service and configuration.
Where a transfer of personal data outside the EEA occurs, we use an appropriate transfer mechanism and safeguards required by applicable data-protection law.
11. YOUR RIGHTS
Where GDPR applies, you may have the right to request access to, correction of, deletion of, restriction of, or objection to processing of your personal data, and to request data portability where applicable.

12. PRIVACY POLICY CHANGES
We may update this Privacy Policy from time to time. We will publish the updated version on this page and update the “Last updated” date. Material changes will be communicated where required by applicable law.
